One of our current issues - which actually prompted the creation of this blog- is the proposed sewer system. At the township meeting tonight (11/4/06) I said that I would copy some of the information that other citizens have gathered and figure out how to put them on the web. So this is my attempt at doing that - and my first blogging experience, so bare with me. This post will change as I am able to gather more information and make it available. The information will be below this introductory paragraph - so read this comment each time as it will change. So start making your comments, sharing opinions, information, & solutions - but please try to be useful and thought-provoking. Let me also be clear that I, like many of you, do not yet have enough information to make an informed decision as to what is best for this community. Whether it ends up being the sewer as proposed, an alternate sewer plan, or septic - I am for whatever plan makes sense for this area. I also will not tolerate any rude personal e-mails (like the one I received yesterday from a sewer board member) from anyone making false accusations as to my beliefs or actions - use the forum - it's open to everyone, state your name, be honest, and be USEFUL!!!! I am only trying to provide a resource, as any good community member or leader would do. *Any information within this document is only to the best of my knowledge, I can not confirm the accuracy of information that is provided, but only just provide it. Do you want to know what the County Council said about the $75,000 to be used for the purchase of land for the proposed sewer plant? Well, you can. It's very important to understand what information they had to work with at the time so read it.
Here is October, 2004 - YOU NEED TO READ THIS -VERY INTERESTING -A rather lively discussion! There is a heated discussion about the date of closing on the sale. You will see what they are referring to on the deed itself (which is located further down in the post.) I requested from the Auditor's Office a copy of the purchase agreement that was referred to in the minutes but was told that that office does not have a copy.

WHAT WERE THE DETAILS OF THIS?
I am still trying to track down the paperwork, but I was told by the Commissioner's that it was structured as a 5 year interest free loan (with the time beginning to run in 2004?) and that they expect to pay it off with the USDA loan/grant $ if approved.
WHAT DOES THE PURCHASE AGREEMENT SAY? WHAT WERE THE TERMS OF SALE, IF ANY?
In the Council meeting minutes there was a purchase agreement referred to and it was said that a copy would be provided to the Council/Auditor. I requested a copy of this from the Auditor's Office and was told that they do not have a copy and that they have requested one in the past. So I went to the attorney's office (Bonnell) to request one but the secretary could not find the file. I called today to follow up and left another message for the attorney. As far as terms of sale, I did not see any within the deed itself (but read it for yourself to see if I missed something) so we would need to see if there is another document (including the purchase agreement) out there outlining any terms.
SO WHERE IS THE LAND THAT WAS PURCHASED?
Below is a copy of an Owen County plat map that shows the area prior to the purchase. It shows that LeRoy Patton and Harmon Crone were the owners. The yellow highlighted area is the area of interest (both far and close-up views.) The Plat Book is available at the Owen County Assessor's Office for $10, located in the Courthouse.

Following the purchase referred to in the above paragraphs, that land is now deeded to the Owen County Board of Commissioners. Below is the current section map for the area of interest, Jackson Township, Section 32, that shows the portion of the above land that was sold to the Owen County Board of Commissioners. It is from far away and close-up, with the land area that we are looking at in the highlighted portion. Copies of the section map can be picked up from the Assessor's Office in the Courthouse. (It's just one page - so you do NOT need to purchase a plat book for that.)


WHAT IS THE CATARACT SEWER DISTRICT AND WHO DOES IT AFFECT?
Good question!! I am currently working on an accurate and concise definition for you. As far as "who and where." I have been told that we can purchase those maps that were shown to us at the last meeting, from the engineering company. I will find out exactly how and let you know.
WHO IS THE SEWER BOARD? HOW WAS IT FORMED? WHO VOTES?
An even better question!! Right now, I am searching through Commissioner's meeting minutes, speaking to Commissioner's, Sewer Board members, and called IDEM to find out these answers. So I will keep adding to this as I get the info. To answer someone's question - some of the sewer board members live in Jackson Twnshp. and some do not. I will give you an exact number when I know it.

WHAT MONEY HAS BEEN APPLIED FOR THROUGH GRANTS OR LOANS?
Indiana USDA Rural Development - Application filed, Pending
There is currently a pending application for money through the Indiana USDA Rural Development Office (which I will refer to as USDA in this blog for short.) After I have a chance to obtain and review a copy of the application next week I will share that with you all. As it was explained to me by USDA however, there are several steps in the loan process. First there's an application, there must also be an engineering report, and environmental report, and some other steps. As I understand it, we are at the beginning of that process.

US Army Corps. of Engineers, Environmental Infrastructures Progam, Section 219 - Letter of Intent Filed
According to the appropriate contact person with the Army Corps, a letter of intent has been filed seeking money through this program. After the letter of intent is filed, authorization must be given (usually through the Water Resources and Development Act) and then the actual appropriation must be made by a member of Congress (i.e. Lugar, etc.) which is usally done through the Energy and Water appropriations bill. This process currently has nothing to do with our local army corps - so do not contact them, they don't have any info. and this is independant of the water quality of the lake.
ENGINEERING REPORT- WHERE IS IT AND WHAT DOES IT SAY?
That is supposed to be provided when I get a copy of the loan app. - so I'll let you know next week.
WATER QUALITY OF THE LAKE - WHAT IS IN THERE?
The Army Corps can be proud of our lake and it's water quality compared to other lakes. They do tests for things like mercury, heavy metals and other items and those reports dating back to 1979 are available at the Cunot Community Center. (as soon as I get this pdf thing figured out they will be here too.) The Army Corps does not currently have any tests on the items that we would need to see if there were fecal contamination. I was told that it is common practice to test beach areas in the summer months for safety so I called the State Health Dept. to see if they have any tests - and am waiting for their return phone call. Other residents pointed out that - according to memory- our beach has not been closed for reasons of contamination. Nor does anyone recall a fish kill, like we have seen all too often in the White River. If anyone has knowledge to the contrary please let us all know a.s.a.p.

1.Review any information that you can find - I will provide what I can on this site and at the Cunot Community Center
2. Write letters to the editor - it's important that the opinions of the community be heard. Look in the Hoosier Topics and the Spencer Evening World for details on how to do that.
3. GO TO THE MEETINGS - both those called by the sewer board and those called by the people of Jackson Township. As soon as individuals provide me with the information I will post the meeting times and locations on this site. Also, check the newspapers for meeting info.
THE NEXT MEETING IS: not been scheduled yet as far as I know

First of all, We think this is a great way for the citizens of Jackson township to be able to voice their opinions. Thank you Kristen.
We believe that one of the first things that need to be done is to follow the money trail. Who is benefiting from all of this? If this is a county project, why isn't the entire county involved? Why just Jackson Township? We understand that projects have to start somewhere, but why with a Township where it hasn't been proven that we are actually a problem? If we do have problems, which we are sure there are some, tell us where they are and let us as a community help one another to fix those problems. We need to hire a lawyer to help us to get to the bottom of everything.

I too am concerned that this project is being blown out of proportions by those that are just a little paranoid. I think it would be very beneficial to distribute some actual fact, possibly by mail, to try and explain the neccesity and ramifications of this project. I also feel it is necessary to mention that their is a fear that if we don't cooperate, our homes will be foreclosed and sold to private investors that are fueling the need for the project in the first place.(city sewer is a plus in a housing development) I would like a bit of comfort and information before i am willing to make a financial or other decision. I would like to know the motivation for this as well so that it doesn't seem like such dirty dealing.

You're a very cruel person to judge others by their income. If it offends you so much, and you seem to be in the minority, why don't "you" move?
How about getting back on the subject - the sewer project. If its necessary, fine. If not, then why waste anyone's money on it?
I don't live in Jackson township, but nearby. I was "very proud" to see that my neighbors are prepared to stand up to big business and government. We ALL should do that!
Once published, I will review the information. If I agree with you, and a petition is started, if allowable, I will sign it.
NO MORE OUT OF HAND GOVERNMENT SPENDING!!! NO MORE TAKING FROM US TO LINE THEIR POCKETS!!!
If this project is necessary, perhaps you'll consider making donations to help others less fortunate than yourself pay the bills, rather than hoping they'll be forced to leave.

Considering that the watershed of Cagles Mill lake is 295 square miles,it is ludicrous to think that spending several million dollars on a sewer system for Jackson Township will have any significant effect on biological waste. I doubt if anyone on the sewer board has considered the amount of wild animal and livestock waste that is washed into the lake. We think that the motives of the sewer board and associates should be questioned and investigated.
all bull aside.i dont think theres very many septics in cunot that would pass.by todays standards.now they want you to have like 500 ft of fingers.well when you have all them trailers 20ft apart there wouldnt even be space for it.and a lot of them are old home made.oil drums for tanks 50 ft shovel dug fingers.opened up to the low places.if it comes through i dont think they would have much trouble comdeming most of the systems.and a new up to code septic system is going to run about 4000 and up.and theres some places that i dont think even have a septic system..the litle white house just west of club 42..a friend of mine lived there some time back.and we spent a hole day trying to figure out where a tank could be.or any fingers..conclusion there isnt any.there isnt any sewage on top the ground anywhere.so it must go in to the ground in the water table some how.and im sure theres many more around like that.i dont know if anybody around there still has well water.but i wouldnt drink it.
There are many things about this sewer project that bother me, but the thing I think many people are losing sight of, though, is that the extremely poor people of Jackson township will probably get aid of some sort to help eliviate the financial burden of this system. But, what about the people who wil not qualify for aid because it is felt that they make too much money, but in all reality, they do not have the money to pay another bill. There are many, many people in Jackson township who have nice homes, who pay their bills, and recieve no assistance, but they are just barely achieving this. Add one more thing to their lists of bills, and they won't be able to make it. What about them? We need to look at every option, and truly think about what is best for the people of Jackson township. How many septic systems could be put in with the money that the board is wanting to use to do their sewer system? Isn't that worth looking into?

i guess poop runs upstream and the next board meeting im wearing my waders i have 2 wells and the waters fine i do filter it. i have a finger system for my upstairs and a septic tank downstairs..i dont need it, i dont want it and as long as i alive it there isnt gonna be 1 shovel full of dirt removed MY PROPERTY i hope the board understands this...i will continue to attend meetings and support my fellow township neighbors. remember ruby ridge, and waco? this may not be much different before its over.
Before I begin my comments on this subject, I want to extend a sincere and heartfelt THANKS to all Veterans for giving us the ability to debate this and all subjects via their sacrifices at the alter of freedom.
I also wish to thank Kristen for the work and effort that it took to make this forum a reality.
My personal hope is that it will allow us all to better understand and appreciate the viewpoints of all who reply regardless of individual opinions.
Having read the Council meeting minutes and having a historical knowledge of the mechanics of Local, State, and Federal government, I hope that we as a community can resolve the issues before us prior to enevitable State or Federal intervention should we choose to do nothing.
That being said, my overwhelming desire is that we can set aside our personal viewpoints that are driven by how this affects us individually and focus on the issue at large as a community.
The issue(s) that caused the formation of a Regional Sewer Board is the undisputed fact that we have many homes in the community that lack any or adequate on site sewage disposal.
Some or possibly many do not have adequate space to allow for any such system.
I suspect that a regional sewer system is being proposed because it would serve many homes simultaneously with one common treatment plant hence making it more cost effective than several small decentralized plants. In addition, only one grant / permit / environmental impact survey is needed rather than several should smaller plants have been proposed.
Are there other options that have yet to be explored that would negate the need for a conventional sewage traetment plant? I hope that others in this forum can think "outside the box" to offer suggestions.
Could one idea possibility be common septic systems that would serve multiple homes?
The down side to any conventional treatment plant is that they are expensive to build, operate, and maintain. These continual residual costs will inevitably rise with time due to economic inflation hence perpetualy increase monthly user costs.
This is all of the time that I have for now but I look forward to partisipating further so long as the comments and suggestions remain by and large constructive and on point.
I will close by saying that I view this Township more so as a group of my neighbors rather than a geographical area. We chose to move to this area in 1990 because of the people and its topographical natural beauty.
In 1990 we had no neighbors within a 1/2 mile radious and now we have many. Although we have lost the solitude that we once had, I realize and identify why someone would want to move to this area as we once did.
It's by this very attaction that this community has grown hence the need for increased cooperation in increasing the infrastructure thereof.

if I was to say what I want to they would come and take me away. so you know what I want to say because most of you feel the same way .they need to worry about real problems in this area like ROADS , and logging trucks running the roads with no escorts and so on !

really? that's the first I heard of it, is it a sewer board or citizens meeting? why on earth at 1p.m. - what about those of us that work during the day, difficult to make arrangements last minute but I'll do my best. I hope others know about it.
